Terms & Conditions

1. Acceptance of Terms

By accessing or using the BidWut platform ("Service") operated by BidWut ("we," "us," or "our"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.

2. Eligibility

  • You must be at least 18 years of age to use the Service.
  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account credentials.
  • One person may not maintain multiple accounts.

3. Bidding

  • All bids are binding. By placing a bid, you enter into a binding commitment to purchase the item at your bid price if you are the winning bidder.
  • Bid types: Quick Bid (next increment), Jump Bid (exact amount), Max Bid (proxy ceiling), and Nuke'Em (beat competitor's max — non-retractable).
  • Bid increments are determined by the current bid amount: $0–$50 = $1 increments; $50–$100 = $5; $100–$500 = $10; $500–$1,000 = $25; $1,000–$5,000 = $50; $5,000–$10,000 = $100; $10,000+ = $500.
  • Soft close: A bid placed within the final 2 minutes of a lot automatically extends the end time by 2 minutes.
  • Bid retraction: You may retract a bid within 15 seconds of placing it, only if you are the current high bidder and more than 1 hour remains. Nuke'Em bids cannot be retracted.
  • We reserve the right to cancel bids that we believe to be fraudulent or made in error.

4. Payment

  • A valid payment method (credit or debit card) must be on file before placing any bids.
  • When you win a lot, your card on file will be automatically charged.
  • Buyer's premium: A 15% buyer's premium is added to the winning bid amount.
  • Sales tax: An 8.5% sales tax is applied to the winning bid amount.
  • If auto-charge fails, an invoice will be issued and you will be required to pay manually through your account.
  • Failure to pay within the allotted time may result in order forfeiture and account suspension.

5. Pickup & Shipping

  • Pickup arrangements are determined by the seller and communicated through the auction listing.
  • Where pickup scheduling is available, you must book a pickup slot within the seller's designated pickup window.
  • Missed pickups may result in rescheduling fees or order forfeiture at the seller's discretion.
  • Some sellers may offer shipping. Shipping availability, costs, and tracking are managed by the individual seller.
  • BidWut is not responsible for items after they have been picked up or shipped.

6. Refunds

  • Refund policies are set by individual sellers.
  • Sellers may issue full or partial refunds for individual line items or entire orders.
  • Refunds are processed back to the original payment method and may take several business days to appear.
  • BidWut facilitates the refund process but does not guarantee refunds. Disputes should be directed to the seller first.

7. Item Condition & Descriptions

  • Item descriptions, conditions, and images are provided by the seller.
  • BidWut does not inspect, verify, or guarantee the accuracy of lot listings.
  • Condition ratings (New, Like New, Good, Fair, Poor) are the seller's assessment.
  • All items are sold "as-is" unless otherwise stated by the seller.
  • It is your responsibility to review all available information before bidding.

8. Seller Obligations

  • Sellers must provide accurate descriptions and images for all lots.
  • Sellers must honor winning bids and fulfill orders in a timely manner.
  • Sellers are responsible for collecting and remitting applicable taxes.
  • Sellers must not engage in shill bidding (bidding on their own items) or bid manipulation.
  • BidWut reserves the right to suspend or terminate seller accounts that violate these terms.

9. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Manipulate bidding through shill bids, bid shielding, or collusion
  • Create multiple accounts to circumvent restrictions
  • Interfere with or disrupt the Service or its infrastructure
  • Scrape, harvest, or collect data from the Service without authorization
  • Impersonate another user or entity
  • List prohibited, stolen, counterfeit, or hazardous items

10. Account Suspension & Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, non-payment, or any conduct we deem harmful to the platform or its users. You may close your account at any time by contacting support, provided all outstanding obligations are settled.

11. Intellectual Property

The Service, including its design, logos, text, graphics, and software, is owned by BidWut and protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written consent. User-generated content (lot descriptions, images, notes) remains the property of the respective author.

12. Limitation of Liability

  • BidWut acts as a marketplace platform connecting buyers and sellers. We are not a party to the transaction between buyer and seller.
  • We do not guarantee the quality, safety, legality, or accuracy of any listing.
  • To the maximum extent permitted by law, BidWut shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
  • Our total liability shall not exceed the fees you have paid to BidWut in the 12 months preceding the claim.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in class action lawsuits.

14. Communications

By creating an account, you consent to receive transactional communications from us via email (order confirmations, payment receipts, etc.). See our Privacy Policy for details on data handling.

14a. SMS Notifications & Consent

  • SMS is optional. Receiving SMS notifications from BidWut is not a condition of using the Service, creating an account, placing bids, or purchasing items. You can use every feature of BidWut without ever opting in to SMS.
  • Phone verification is separate. Verifying your phone number is a one-time security step that confirms your identity for bidding. Verifying your phone does not grant consent to receive SMS notifications. Consent to SMS is captured by a distinct, optional checkbox shown during signup and in your notification preferences, which is unchecked by default.
  • Express written consent. If you do choose to opt in, you affirmatively check the SMS-consent checkbox bearing the text: “I agree to receive SMS notifications from BidWut about my account activity (outbid alerts, pickup reminders, etc.). Msg & data rates may apply. Reply STOP to opt out.” We record the timestamp and text of your consent for our records.
  • What we send. Only account-related notifications you have opted into via your notification preferences, including: outbid alerts, auction-start reminders, won-lot confirmations, payment receipts, pickup-window reminders, and refund notifications. We do not send marketing SMS.
  • Frequency. Message frequency varies based on your bidding activity and the specific notification types you enable. You may receive multiple messages during active auctions you are participating in.
  • Carrier fees. Message and data rates may apply per your mobile carrier's plan. BidWut does not charge for SMS messages.
  • Opt-out. Reply STOP to any SMS we send to immediately stop all future SMS messages. We will send a single confirmation message acknowledging the opt-out. You can also disable SMS at any time by toggling off the Text channel in your account's notification preferences. Opting out of SMS does not affect your ability to use the Service.
  • Help. Reply HELP to any SMS we send for support, or contact [email protected].
  • Supported carriers. Major U.S. and Canadian carriers are supported. Carriers are not liable for delayed or undelivered messages.
  • Privacy. Your phone number and SMS preferences are handled in accordance with our Privacy Policy. We do not sell or share mobile information (phone numbers or SMS opt-in status) with third parties for their marketing purposes.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email to registered users. Continued use of the Service after changes are posted constitutes acceptance. If you disagree with any changes, you should stop using the Service and close your account.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
